These terms cover your use of the Global Tour Creatives website at globaltourcreatives.com and the GTC Force client portal. Global Tour Creatives ("GTC," "we," "us") is a creative and advertising agency for live entertainment tours, based in Los Angeles, California.

By using the website or GTC Force, you agree to these terms. If you use them for an organization, you confirm that you are allowed to agree for that organization. If you do not agree, please do not use the website or the portal.

How we handle personal information is described in our Privacy Policy, including our internal tools that read advertising performance data from GTC's own Google Ads and Meta ad accounts.

The website

The website describes our work and gives you a way to contact us. We may change, pause, or remove parts of the site. Content on the site is general information about GTC. A particular result, date, or price for your tour is set in a quote or a contract, not by a page on the site.

GTC Force accounts

GTC Force is our client portal. We provide accounts to clients and to people a client authorizes. Keep your account information accurate and up to date.

You are responsible for your login and for activity under your account. Do not share your password. Email info@globaltourcreatives.com if you think someone else is using your account.

We may refuse, suspend, or close an account if we reasonably believe these terms or a client contract have been broken, if we need to protect the portal or other users, or if the client relationship has ended. You may stop using the portal at any time. Closing access to the portal does not, by itself, cancel a signed contract.

Orders and the client contract

A request you submit through GTC Force is an offer to order services. We accept it only when we confirm it in the portal, by email, or in a contract. We may decline a request. What we will deliver, when, and for what fee are set out in that confirmation or contract.

Paid creative and production work is covered by the statement of work, order, or other contract we enter with the client. If that contract and these terms ever differ, the contract controls for that work. These terms still apply to use of the website and the portal.

Intellectual property

GTC and its licensors own the website, including its design, text, and graphics, and the GTC name and logos. You may not copy the site or use our name or logos, except as needed to use the site and portal, or as a contract allows.

Materials you or your organization give us, including artist assets, logos, photography, and briefs, stay with you or your licensors. You confirm that you have the rights we need in order to use those materials for the work.

Ownership of creative deliverables we produce for a client, including concepts, designs, layouts, and production files, is set by that client's contract. These terms do not change that contract. Where a contract does not say otherwise: we keep our pre-existing tools, templates, and know-how; rights in the final deliverables pass to the client once the contract's conditions, including payment, are met; and until those conditions are met, we reserve all rights in the work. Unused concepts and our working files stay with GTC unless the contract says they transfer.

If you send us ideas about the website or the portal, we may use them to improve the site or portal, with no duty to pay you for that feedback.

Acceptable use

You agree that you will not:

  • Break the law, or infringe someone else's intellectual property or privacy rights
  • Upload or send material you do not have rights to use
  • Try to open another client's account, orders, or files
  • Probe, scan, or test the site or portal for weaknesses, or bypass a login or other access control
  • Interfere with the site or portal, including by sending malware or by overloading the service
  • Use the site or portal to send spam, or to collect information about other people without a proper reason
  • Misrepresent who you are or who you work for
  • Use automated tools to pull data from the site or portal in a way that strains the service
  • Use GTC Force except for a real client engagement with us

Disclaimers

The website and GTC Force are provided as available. We work to keep them accurate and running. We do not guarantee that they will be uninterrupted, free of errors, or free of harmful components. Information on the website can change, and we may correct it without a separate notice.

Creative work is prepared for the client named in the contract, for the use that contract describes. A use the contract does not cover is outside what we have agreed to stand behind.

Limitation of liability

To the fullest extent California law allows, GTC and its people are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, arising out of your use of the website or GTC Force, even if we knew such damage was possible.

To the fullest extent California law allows, GTC's total liability for a claim about the website or the portal, as distinct from a claim under a signed client contract for paid services, is limited to the greater of the amount you paid us for use of the portal in the three months before the claim, or one hundred U.S. dollars (USD 100). Claims about paid creative or production services follow the client contract.

These terms do not limit any liability that California law does not allow us to limit, including liability for fraud or willful misconduct.

Other websites

The website may link to sites that we do not run. Those sites have their own terms and privacy practices, and we are not responsible for them.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The state and federal courts located in Los Angeles County, California, are the venue for a dispute arising out of these terms or out of use of the website or the portal, and you agree to personal jurisdiction there. Either party may still ask a court for an order to stop misuse of intellectual property or unauthorized access to the portal.

Changes

We may update these terms. When we do, we will change the "Last updated" date at the top of this page. The updated terms apply to use of the website and the portal after that date. If you have a GTC Force account and a change materially affects how the portal works, we will make a reasonable effort to tell you by email or through the portal. An update to these terms does not amend a signed client contract.
